The strength of Eric’s expertise lies in representing both insureds and insurers in complex defense litigation. He has deposed plaintiffs, law enforcement witnesses, treating physicians, and forensic and other expert witnesses. Commercial Litigation

Eric has litigated cases involving construction and property defects, contract disputes, restrictions on rights to work, and covenants not to compete, as well as personal injury matters involving construction accidents, motor vehicle accidents, and slip-and-fall events. Criminal Appeals

Eric is a veteran of appellate court in New York, where he has successfully argued nearly 100 appeals before the Appellate Division. He has also argued before the New York’s highest court – the Court of Appeals. Eric specializes in habeas corpus and post-conviction relief in both state and federal courts.

Representative Cases

Representation of property owners seeking special use permit to convert single-family residence to two-family dwelling, within the parameters of the Zoning District at the time. Successfully argued Article 78 proceeding in New York State Supreme Court, overturning Village of Geneseo Planning Board’s earlier denial of special use permit request.

Successfully appealed lower court ruling using novel evidentiary argument contending that County Court erred in precluding defendant from examining and cross-examining certain witnesses with respect to a previous allegedly false allegation, calling into question complainant’s credibility (People v. Bridgeland, 19 AD3d 1122 [4th Dept 2005]).

Challenged Family Court order that prohibited client from procreating. Argued successfully, citing language in governing statute and regulations, as well as case law that the Family Court had no authority to issue an order of “no pregnancy” (see In re Bobbi Jean P., 46 AD3d 12 [4th Dept 2007]).
